It is always in question whether the words are used in such a nature as to create a clear and present danger that they will bring about a danger that Congress has a right to prevent.
Things that may be protected under Constitutional rights while in a time of peace, may not be protected while at a time of war, especially if said actions were to hinder or be an obstruction of the effort.
If the act, its tendency and the intent with which it is done are the same, we perceive no ground for saying that success alone warrants making the act a crime.
